A Court fee of £385 is payable upon submission of the application to the Court of Protection and as soon as the Order has been issued, the Deputy must arrange a Security Bond.

Further fees are payable to the Office of the Public Guardian upon the appointment of the Deputy and on an annual basis going forward in connection with their supervision.

If we are instructed to assist with the application, we will charge for the time incurred on an hourly rate set by the Court. All costs relating to the appointment of a Deputy can usually be recovered from the person who lacks mental capacity.

Often, the proposed Deputy pays the costs and is then reimbursed once the Deputyship Order is made and they have access to the bank account of the person who lacks mental capacity.
